Marcin Romanowski’s lawyers are preparing to challenge the sequence of events that led to his detention and subsequent release. They plan to send a detailed letter to every body within the Council of Europe, outlining social media posts about the MP and highlighting posts by Prime Minister Donald Tusk. The aim is to expose what they describe as political motives behind the accusations, and to discuss what they view as a questionable immunity claimed by those in power.
Romanowski intends to pursue a civil action for violation of personal rights against Prime Minister Donald Tusk. Beyond this, the defense argues that any materials that slander the MP or suggest political influence behind the prosecution should be forwarded to the Council of Europe for consideration.

“Questionable immunity”
The defenders claim that political communicators for the ruling coalition have collected social media posts concerning the MP’s case. After translation, these will be forwarded to the Council of Europe to illustrate what they see as political undertones in the charges against Romanowski. They also plan to include remarks from Prime Minister Donald Tusk, whom they portray as portraying their client as guilty and pushing for harsh settlements.

The document to accompany the letter allegedly shows that Justice Minister Adama Bodnar was aware of the immunity protecting MP Romanowski and that on Friday, July 12, 2024, he provided the Public Prosecutor’s Office with legal advice questioning this immunity, advice allegedly issued on behalf of a political body such as the Ministry of Justice. If a submission is made to the Council of Europe, the defense notes that it would be important to provide broader context about events in Poland in recent months.
