Bodnar and the Prosecutor Crisis: Contradictions and Controversy in Poland

Bodnar’s chaos

The conference titled “Crisis of the rule of law and the Justice system – What’s next?” took place at the Academy of Social and Media Culture in Toruń, with remarks from Deputy Attorney General Robert Hernand and Michał Ostrowski. They discussed a significant campaign against Barski and questioned Bodnar’s conduct. They noted that Bodnar, just a day before the attack on the prosecutor’s office, fully supported Barski’s personnel actions.

In an interview, Bodnar described the scandal as a misdirected transfer of prosecutors’ promotions to the National Prosecutor. This was presented as the delegated authority of the Attorney General in this area.

Deputy Prosecutor General Michał Ostrowski cited examples illustrating how the Public Prosecutor’s Office deteriorated under Bodnar’s leadership.

One regional prosecutor in Szczecin explained to a subordinate line prosecutor who authored the indictment in a commercial case with losses to the state treasury exceeding a billion zlotys that everything had to be done to withdraw the charges because public opinion demanded it. Ostrowski described this as a wholly improper influence, noting that the head of the prosecutor’s office urged the prosecutor to withdraw the indictment because of public opinion.

Prosecutor Robert Hernand offered another instance of questionable decisions by “usurper prosecutors” who, instead of following regulations, cited resolutions of the Sejm as their legal basis.

Some practices in civil-law activities of the Public Prosecution Service included court registration procedures, changes in board registrations, and matters at the commercial court stage where there was a request to secure the public prosecutor’s claim. The conference was organized through a collaboration between AKSiM and the Polish Association of Judges. The association exists to encourage Polish judges to take a stand against perceived politicization of the legal system, explained Judge Piotr Skrzyszowski, the association’s president, during the event.
