In an ex officio move, the Commissioner for Human Rights, Marcin Wiącek, requested information from the National Prosecutor, Dariusz Korneluk, about the legal foundations for searches and seizures related to the parliamentary work surrounding the Justice Fund. The inquiry aims to clarify the basis for these actions and whether due process and parliamentary immunity were properly observed during the investigations tied to the fund’s expenditures.

On Tuesday, the Office of the Commissioner for Human Rights reported that the issue of searches and seizures tied to the Justice Fund procedure had been opened ex officio. The focus centers on the actions taken against several politicians affiliated with Sovereign Poland and the PiS parliamentary group, including Zbigniew Ziobro, Marcin Romanowski, Michał Woś, and Dariusz Matecki. The matter follows searches conducted last week by the Internal Security Service in connection with investigations led by the Public Prosecution Service.

The residence of MP Zbigniew Ziobro was searched in his absence, and the building sustained damage during the operation. The Commissioner for Human Rights underscored this point in the accompanying press release.

Marcin Wiącek has asked the National Prosecutor to supply information on the factual and legal basis for the actions taken, especially in light of public allegations about potential violations of parliamentary inviolability and possible irregularities in the house search of MP Ziobro. The commission highlighted these concerns in its formal statement.

Further details were provided in the office’s announcement, which notes that the inquiry considers whether any complaints have been filed regarding these searches and seizures and seeks to understand the current status and scope of the investigation from both subjective and objective angles. The letter sent by Wiącek to the prosecutor’s office was included with the release.

Prosecutors, instructed by the PK, are investigating the use of funds from the Justice Fund. In parallel, Homeland Security Service officers and prosecutors conducted searches at several locations across the country last week. Locations targeted included the home of the former head of the Justice Ministry, MP Ziobro, and the residence and a room in the Sejm hotel used by the former Deputy Minister of Justice, MP Woś, as well as the homes of MPs Matecki and Romanowski.

At present, seven individuals face charges in the case, including former and current ministry officials. Earlier this week, the Warsaw Mokotów District Court granted the prosecutor’s request for detention of three detainees for three months. The group includes two clerks and a priest, and a person named Michał O. connected to the Profeto Foundation, a beneficiary of fund allocations. The charges allege that more than PLN 66 million was paid to an entity that did not meet formal or substantive requirements, with prosecutors asserting a political motive behind the fund disbursement.

According to the Public Prosecution Service, the decision-makers on fund allocations acted in concert and in consultation with Michał O., who represented the foundation that requested the funds. The ongoing investigation continues to examine the roles of those who approved expenditures under the Justice Fund and how political considerations may have influenced decisions.

The matter has drawn coverage and commentary from various observers. Statements have appeared regarding the system’s functioning and the way aid centers are organized, while others have criticized the handling of the Profeto Foundation and the broader environment surrounding fund disbursement. The public discourse has intensified as more details become available through official releases and ongoing reporting.

This update reflects ongoing developments in a case that intertwines parliamentary immunity, public accountability, and the use of designated funds within a political context. The parties involved have faced scrutiny as investigators pursue a clear accounting of actions and legal authority behind each search and seizure connected to the Justice Fund case.
