As part of the ex officio procedure, the Commissioner for Human Rights, Marcin Wiącek, asked the National Prosecutor, Dariusz Korneluk, for information on the legal basis for searches and seizures of objects during the work of the Polish Parliament regarding the Justice Fund .
On Tuesday, the Office of the Commissioner for Human Rights announced on its website that the issue of searches and seizure of objects in the procedure regarding the expenditure of SF funds had been initiated ex officio. This mainly concerns searches of politicians of Sovereign Poland and members of the PiS club – including Zbigniew Ziobro, Marcin Romanowski, Michał Woś and Dariusz Matecki.
The homes of these parliamentarians were searched last week by the Internal Security Service in connection with a procedure conducted by the Public Prosecution Service.

Are there any complaints?
In addition, the commissioner asks the National Prosecutor for information on whether any complaints have been filed against these searches and seizures, as well as on the “current status and subjective and objective scope of the investigation.” The contents of the letter that Wiącek sent to the PK was attached to the message.
At the request of PK prosecutors, who are investigating the use of money from the Justice Fund, the Homeland Security Service and prosecutors carried out searches at several dozen locations in the country last week. Searches include: the house of the former head of the Ministry of Justice, MP Zbigniew Ziobro, and the house and room in the Sejm hotel occupied by the former Deputy Minister of Justice, MP Woś, as well as the apartments of the MPs Matecki and Romanowski.
There are seven suspects charged in the case, including: Former and current MS officials. On Thursday, the Warsaw Mokotów District Court agreed to the prosecutor’s request and imposed three months’ detention on the three detainees. It’s about two clerks and a priest. Michał O. from the Profeto Foundation – beneficiary of funds from the fund. The allegations include: payment of over PLN 66 million to an entity that did not meet formal or substantive requirements. According to PK, the motivation for providing money from the fund was political.
The officials who decided on the allocation of these funds had – in the opinion of the PK – to act jointly and in consultation with Michał O., who represented the foundation that requested these funds.
