Three Counts in Mallorca Case Highlight Harsh Penalties for Sexual Assault of Minors

Cive young men face a total of ninety years in prison after allegations of gang rape involving two underage girls in Cala Ratjada, Mallorca. Prosecutors say the defendants forced the victims, aged 15 and 16, into a car and drove them to a secluded area where they were sexually assaulted. The two girls have required psychological support, and the public prosecutor seeks damages of 70,000 euros for each of them. A preliminary hearing in Palma’s Provincial Court is scheduled for tomorrow.

The events unfolded in the early hours of November 30, 2019. According to the state attorney, one of the suspects walked with the two minors toward a nightclub when the other four defendants arrived in a car. The youths forcibly placed one girl in the back seat and the other in the trunk of the car. The former was subjected to touching all over her body despite her pleas to stop and her requests to exit the vehicle.

With the two victims aboard, the car headed to a remote location, as detailed by the Fiscalía. There, two of the accused allegedly attempted to coerce one girl into giving a sexual act. When she refused, one of them grabbed her, pulled down her pants, pressed her against a stone wall, and raped her despite her efforts to break free by biting his neck and mouth.

The other teenager was removed from the trunk and placed in the rear seats of the car where three of the youths closed in with her. She was driven to another site where they again touched her and tried to force sex. She resisted strongly and did not comply.

Subsequently, the attackers and the victim returned to the location where the remaining participants were waiting, and several of them again assaulted the girl who had remained in the car.

The two minors reported the incident, and the five defendants were detained by the Civil Guard. A court released them under bail conditions and issued protective orders to keep them away from the victims.

Three charges

The Fiscalía accuses the five defendants of three counts of sexual assault, one involving penetration. For one of the accused, who is alleged to have participated in all offenses as an accomplice, prosecutors seek a 30-year prison sentence. The other four defendants face separate requests for 15 years in prison each.

The public prosecutor notes that both victims required psychological support as a consequence of the assaults. As a result, the state seeks 50,000 euros in damages for one of the injured parties and 20,000 euros for the other, to cover moral damages. Tomorrow’s preliminary hearing in the second section of the Palma court has been scheduled to begin the proceedings.
