Apple has asked the US District Court for the Northern District of California to dismiss a lawsuit filed against Israeli company NSO Group, the developer of the Pegasus spyware for iOS. The main reason for the retraction was the risk of revealing important information about the security system of Apple devices during the investigation. reports SecurityLab cited a copy of the petition filed by Apple and published in Courtlistener.
In addition, Apple made its decision based on the fact that the situation in the commercial spyware industry has changed significantly since the lawsuit was filed in 2021. NSO Group has lost its leading position, and other players have entered the market. The Cupertino team believes that a victory over a single company will no longer have the effect they expected.
Apple continues to improve user protections and is concerned that disclosing information about the system in court could compromise its effectiveness. The company also cited media reports about possible leaks of material from a similar case WhatsApp filed against NSO Group.
Apple stresses that it is confident in the validity of its claims against NSO Group, but has decided to focus on technical methods of combating spyware so as not to jeopardize users’ security.
The court hearing where the petition will be evaluated will be held on October 24, 2024.
