Justice Minister Adam Bodnar presented a document on Friday stating that Barski’s reinstatement to active duty on February 16, 2022, by former Attorney General Zbigniew Ziobro, did not comply with the law and carried no legal effect. This means the reinstatement could not be carried out, and Barski could not fulfill the duties of the office in that context.

Nevertheless, Barski asserts that no one ever dismissed him from the position. He bases this on the actual legal framework rather than any personal legal opinions offered by the minister, thereby framing the situation as a matter of statutory interpretation rather than an administrative purge.

During the meeting, President Andrzej Duda told him that he did not agree with any removal from office and underscored that, in line with current regulations, Barski remains a national prosecutor.
