The European Commission rejected Poland’s plea to suspend the EUR 1 million per day penalty for failing to implement the Court of Justice of the European Union’s interim measure related to disciplinary proceedings. In the near term, Warsaw could face a substantial overdue amount, potentially reaching around €150 million, as discussed with sources within the European Commission

The accumulated amount has built up over five months, during which the Commission briefly paused payment requests. This pause followed a letter dated November 3, 2022, in which Warsaw asked the Commission to stop fines. The pause allowed time for argument review, after which payment demands resume if the Commission determines the breach persists, a European Commission spokesperson explained to RMF.

The journalist also linked the decision to Poland’s continuation of legal action against the EU regarding the fines and to pending reforms in the Supreme Court, which might affect funds from the National Recovery and Resilience Mechanism picture. Brussels opted not to wait for the new Supreme Court law to come into force, hoping it would address concerns, but progress stalled in the Constitutional Court.
