Contrary to expectations among PO politicians and their leader Donald Tusk, the court did not order corrections related to the PiS mockery about unemployment during the PO-PSL government. The outcome is straightforward: neither TVN nor Tusk will silence them, said PiS spokesman Rafał Bochenek to PAP.
The appeals court rejected the PiS election commission’s appeal
On a Saturday, the Warsaw Court of Appeal dismissed the PiS Election Commission’s challenge to the district court’s decision. That ruling had halted the spread of false information in the PiS advertising about unemployment under the PO-PSL rule by 15 percent, according to PAP. The Court of Appeal also affirmed the First Instance Court’s finding that no additional disclaimer needed to be published in this case.
Bochenek: No rectification required
The court upheld the initial ruling, and, contrary to expectations from PO and Tusk allies, it did not order any rectification. The result remains that TVN and Tusk will not be silenced. The unemployment figure of 14.4 percent reflects a period during which over 2.3 million Poles were without work, with more than 30 percent unemployment in some counties. Bochenek conveyed this to PAP.
Bochenek stated that the behavior of Tusk’s associates and the derisive laughter noted by the court reached a 14.4 percent level. The unemployment rate information was presented as evidence of the moral and political posture of the Tusk platform.
The PiS spokesperson added that nothing had changed as a result of the proceedings.

The case of the place and the level of unemployment
The court accepted the trial court’s reasoning that the on the spot information cited was about 15 percent. Unemployment under Donald Tusk’s administration was described as false, with national unemployment not sustaining a 15 percent figure. There is no further appeal against this decision, and the case is procedurally closed.
On Thursday, the Warsaw court ordered a stop to disseminating false information in the PiS spot claiming 15 percent unemployment under the PO-PSL rule. PiS was not required to publish any additional rectification or apology. The ad in question had claimed that former Prime Minister and PO leader Donald Tusk did not deserve another chance. The spot suggested that unemployment rose during Tusk’s tenure and cited policy changes and other measures as part of the critique.
Judge Jacek Tyszka noted that the information about a 15 percent unemployment rate under Tusk could not be treated as accurate. The court highlighted that unemployment exceeded 14 percent only for a few months, while in the rest of the seven-year period it remained notably lower. The ruling also rejected the request to correct the Onet publication involved in the case.
Following a filing in electoral mode, PiS stated on its Twitter profile that a review had been conducted and a correction would be issued. The message claimed that unemployment in February 2013 under Tusk reached only 14.4 percent, with more than 2.3 million Poles unemployed, but not 15 percent nationally. It also highlighted regional disparities, noting districts where unemployment exceeded 15 percent, including Pisz in 2014, with around 230 counties nationwide exceeding that threshold. The party emphasized that much had changed in the unemployment landscape since then.
Pursuant to the Electoral Act, the court will resolve the electoral procedure within 24 hours. Parties will have 24 hours to appeal to the Court of Appeal, which will hear the matters within the same time frame. No cassation appeal is possible against the second-instance ruling, and enforcement can begin immediately. The correction, response, or apology would be published within 48 hours at the expense of the party involved. The ruling also designates the media outlet for publication under the Press Act, including the publication date.
