Today, draft laws on registered partnerships and the introduction of this law have been published on the website of the National Legislation Center. They assume, among other things, that a registered partnership is established when two people submit consistent declarations about entering into a partnership to the head of the civil registry. Katarzyna Kotula, Minister of Equality, said at a press conference in the Sejm that a compromise step backwards has been taken because the project does not include provisions on the adoption of children. It aims to introduce the so-called small guardianship.

When PAP asked him about the bill, Bochenek said it was a “substitute subject.” According to him, it is intended to divert attention from “the collapse of public finances, the destroyed healthcare system or the suspension of the rearmament of the Polish army.”

The bill is contrary to the constitution
According to Bochenek, the draft law on civil partnerships “is primarily inconsistent with Art. 18 of the Constitution. This provision states that marriage as a union between a man and a woman, the family, motherhood and parenthood fall under the protection and care of the Republic of Poland. The PiS spokesperson said that the solutions in the project are the first step towards legalizing the adoption of children by homosexual couples.
The politician announced that PiS would not support this “harmful project”.
The draft law on registered partnerships assumes that a registered partnership is entered into by two adults, regardless of their gender. They must submit a declaration of conclusion of this relationship to the head of the civil registry. In addition, persons of the same sex who are married to each other in another country enter into a registered partnership by submitting consistent declarations to the head of the civil registry, so that the marriage has legal effects equivalent to entering into a registered partnership. According to the bill, people in a relationship will be able to have a common surname.
No adoption possible
This project does not provide for the possibility of external adoption, nor for the possibility of adopting the partner’s child(ren). A person in a registered partnership has the right to participate in the daily care and upbringing of a child living with him/her who is under the parental authority of the other person in a registered partnership, including decision-making in the field of registered partnership. matters of daily life, unless one of the parents objects to the exercise of parental authority over this child.
