Civic Platform MP Małgorzata Niemczyk commented critically on the major infrastructure projects of the Law and Justice government in a rather straightforward, joking tone. PiS MP Marcin Horała, former government plenipotentiary for the CPK, responded to her on social media.
MP Niemczyk made a statement to Wirtualna Polska in which she joked that if all the PiS government’s investments were implemented, there would be no cement factories in Poland.
I don’t know if if we started all the projects that the PiS team tried to convince us to do, there would be enough cement factories in Poland. Would we have sufficient material for other investments, for example the construction of apartments, school or sports halls? How much would the price of one square meter of an apartment be? This investment, CPK together with HSR, will suck everything out of the market. Teams, equipment, products, semi-finished products, materials… Meanwhile, I have not seen any analyzes on this topic

Her controversial opinion was seriously and substantively commented on social media by PiS MP and former Deputy Minister of Infrastructure, Funds and Regional Policy, Marcin Horała.
There are jokes from MP Małgorzata Niemczyk about the missing cement factories. In the meantime, this is not as stupid a statement as it seems. Let us perhaps rephrase it and assume that the Member wanted to ask whether the volume of construction work orders, given the superficiality of the construction market with the right capabilities, will not result in a speculative bubble in the prices of works? Well, such a risk actually exists. The mere fact that risks exist cannot invalidate the program. Then by definition we would never be able to make larger investments

The Law and Justice MP noted that these types of risks can be controlled, and the United Right government has taken many measures to this end.
We are in constant dialogue with the construction industry and our intentions are communicated many years in advance. There is time to invest in the right capabilities. We have taken proactive steps to attract large global companies with their virtually unlimited capabilities to consortia with Polish companies: for example, Dowha Engeenering, which is already a member of consortia participating in our tenders
– he said.
We make extensive use of window tenders, where a shortlist of companies is selected for the entire contract package. These companies now know for sure that they have a seat at the table where the contract pie is shared and that they can safely invest in developing their capabilities. We are building competencies on our side by increasingly using open book contracts, which eliminate most of the risks on the contractor side (but require a very different level of competency on the client side). This means that we do not pay in the offer price for risks that the contractor must include in the price and that may never occur.

Investment philosophy
The politician explained that the PiS government’s investment program was intended as a kind of comprehensive infrastructure philosophy, and not as a response to immediate needs.
The entire program is managed – for the first time in Poland – based on the philosophy of managing the entire portfolio, not from contract to contract and whatever comes out of the tender, we do randomly. Naturally, this philosophy involves a very careful use of the design and build formula, which only works well with simpler, typed projects.

We have acquired the leading Polish company for the construction of railway infrastructure – Torpol – by the CPK capital group. Apart from the execution of some contracts (for which the country could again safely invest upfront in the development of capabilities), it would be used to benchmark the market by inviting tenders with offers with fairly calculated good margins (so if you If you win the tender, you cannot submit a bid with an absurdly high margin, because you will lose with Torpol’s bid). It would also serve as an ‘investment fire brigade’, making the capital group more resistant to tricks like: ‘we know we broke the contract, but if you impose fines on us under the contract, we will leave the construction site and you will face greater having problems.”
