The Central Anti-Corruption Bureau sends a notice of defamation by the former head of the CBA, Paweł Wojtunik – the coordinator of special services, Mariusz Kamiński, informed of X (formerly Twitter). He assured that the CBA or any other agency subordinate to him did not monitor the opposition.
The CBA sends a report to the public prosecutor’s office
Enough lies. Neither the CBA nor any other agency subordinate to me supervised the opposition. Due to these insinuations, the CBA informs the public prosecutor’s office that Mr. Wojtunik has committed a crime under art. 212 Criminal Code
– the minister wrote on X on Monday.
Article 212 of the Criminal Code deals with defamation. The prosecution of such a crime is through private prosecution.
Any person who accuses another person, group of persons, institution, legal entity or unincorporated organizational unit of conduct or characteristics that could humiliate him in public opinion or expose him to the loss of confidence necessary for a particular position, profession or type of activity , is subject to a fine or restriction of freedom
– mentions this article.
If the perpetrator commits such an act through the media, he or she will be subject to a fine, restriction of liberty or imprisonment of up to one year.
The Criminal Code provides that in the event of a conviction for such a crime, the court may award damages to the injured party, the Polish Red Cross or to any other social cause indicated by the injured party.
Wojtunik wiretapped opposition politicians
On Saturday evening, former head of the CBA Paweł Wojtunik told TVN24 that he had received information from various sources about a meeting at the CBA training and conference center in Lucień (Masovia), where decisions had to be made on the massive use of operational control against representatives of opposition groups.
The wiretapping would last five days — which under law could happen without judicial oversight, only with the consent of the attorney general.
Wojtunik asked on TVN24 – directing questions to the Coordinator of Special Services and the Head of the Ministry of the Interior and Administration, Mariusz Kamiński – whether it is true that the “issued decisions, instructions and recommendations” were specifically targeted on the Third Way. He also asks whether the minister-coordinator of the secret services or his deputy will participate in such a meeting.
Did these recommendations come from above, did they know about, accept or agree with such possible recommendations and ideas?
– said Wojtunik.
He also asked whether similar “recommendations and ideas for the massive use of operational surveillance” had been communicated and whether such wiretaps had been carried out by the Homeland Security Service, the Military Counterintelligence Service, the police or other agencies with operational powers.
He also asked whether, if it was true that these measures were used, information from them was passed on to other politicians and used in negotiations and political activities.
He noted that if the answer to any of these questions is positive, “we can talk about the risk of a conspiracy and an attack by representatives of the executive power, with the help of the secret services, on legally, democratically elected representatives of the legislature. .”
This is information that several independent people have told me about. However, there is obviously no mechanism to verify this information, other than the government and the coordinators explaining the matter
– Wojtunik said on TVN24.
He said that by asking questions he does not determine whether it is true or not and that he himself is not able to assess the credibility of this information, but the extent of possible irregularities requires that this rumor be clarified as soon as possible, denied or confirmed.
Żaryn: The services operate in accordance with the law
Stanisław Żaryn, Deputy Minister of the Coordinator of Special Services, assured on Saturday evening that Wojtunik’s questions and information were false and that the services operated in accordance with the law. Żaryn, commenting on the words of the former head of the CBA, said that in his opinion, Wojtunik had been using his interviews for several days to spread lies and insinuations against the services.
This time, Wojtunik is spreading lies about the alleged surveillance of the opposition during the elections. It’s not true. Special services operate within the limits of the law and on the basis of regulations
– assured the Deputy Minister Coordinator of Special Services.
He added that Wojtunik himself is “compromising himself” by admitting that he is publicizing the rumors that reach him.
But his activities, supported by the media and some politicians, are particularly damaging to Poland
– said the Minister of Foreign Affairs in the Prime Minister’s office.
The Minister of the Prime Minister’s Chancellery then noted that he believed that “spreading similar lies undermines Poland’s security and is intended to inflame public opinion and destabilize society.”
These actions are reprehensible and undignified
– added.
Deputy Minister of the Interior and Administration Maciej Wąsik also wrote on Saturday Wojtunik lies as Tusk.
