Zaragoza Case: Juridical Proceedings Involving Alleged Coercive Sexual Acts

In Zaragoza, yesterday the first episode of a high-profile case unfolded in a state court. A young man identified as Daniel AR faced charges in a sealed courtroom after allegations emerged that he forced a partner of fifteen years to have sex without a condom up to three times. The prosecutor’s office, along with attorney Amanda Lahoz, filed a special case seeking a substantial prison sentence and financial restitution to the victim. The request called for eleven years of imprisonment for repeated offenses against sexual freedom and a compensation payment of 3,000 euros to acknowledge the harm caused.

According to the prosecutor’s certificate, the events date back to the afternoon of September 14, 2021, in the capital of Aragon. On that day, the two individuals allegedly met on Instagram with the intention of spending time together at the defendant’s residence, where sexual activity occurred. It appeared to be a recent encounter rather than a long-standing relationship.

Once inside the room, the defendant reportedly claimed that there was no condom available, and he insisted on proceeding without protection despite the victim’s refusal. He pressed with phrases meant to coerce compliance, including assurances and pressure, such as promises of trust and statements implying consequence if she did not acquiesce.

According to the public prosecutor’s account, the defendant suddenly laid the victim on the bed, positioned himself over her, and forcibly restrained her arms to engage in sexual intercourse. This sequence is described as an act of coercive sexual contact against the victim’s will.

The victim did not resist while recalling that the accused carried a knife at times, a detail he reportedly used to deter resistance. It is noted that the bedroom door was locked, and a Pitbull mix dog resided in another part of the house. The presence of the weapon and the locked door are cited as elements that likely heightened the fear and limited the ability to seek help at the moment.

Despite ongoing resistance, the defendant allegedly compelled the victim to engage in further acts on two additional occasions under conditions mirroring the initial incident. After the third and final episode, the door latch was released, allowing the victim to leave the residence.

The prosecutor’s office filed the report with the National Police, describing the sequence of events and the circumstances surrounding the alleged offenses. On September 19, authorities imposed a precautionary measure restricting the accused from certain activities for a period of fifty days, reflecting concern for the victim’s safety and a need to limit potential contact between the parties during the investigation. The claim highlights visible injuries, including bruises on the arms and legs, aligning with a pattern of harm described in the report.

The request from the public prosecutor and the special prosecutor also seeks a financial penalty for the alleged minor injuries, set at 320 euros, along with a separate 40-day period of additional penalties amounting to eight euros per day. The case also considers aggravating factors related to kinship, which could influence the overall legal assessment and potential sentencing.
