The Vigo Court of Instruction 6 convicted former gang member Manuel Baña Gil and a young man identified as Pablo R.R., who, months later, fired shots on two occasions in Castrelos Park during a dispute over their dogs. The court attributes them each with minor injuries, because both acknowledged the confrontation. While the young man attempted to defend himself, he caused a wound to the former gang member, who remains in provisional detention.
The magistrate ordered a fine of 360 euros for each, along with payment of civil liability, with the amounts treated as equivalent and thus commuted.
In the trial held on March 22, both defendants, who simultaneously acted as complainants and respondents, offered inconsistent accounts of what happened on the morning of June 5, 2023. During the hearing, Manuel B.G. appeared via videoconference from A Lama prison, where he is detained for allegedly having fired a weapon at the same youth three months later, and for another altercation related to the dogs in Castrelos Park.
The magistrate notes that the dispute in Castrelos Park began when one of Manuel’s dogs approached Pablo’s dog, prompting Pablo to reprimand him about his pet’s behavior.
From there, the two versions diverged, with each accusing the other of assault. A witness’s testimony failed to clarify who started the fight, and the judge indicated that the testimony of Pablo’s girlfriend cannot be given probative value due to her relationship with him and her evident interest in the proceedings.
Because of this, the decision relies on the police report, which confirms that both parties showed injuries, later corroborated by medical-forensic reports.
