A 26-year-old man received a two-year prison sentence on Monday in Alicante after being found guilty of sexually assaulting two minors at the Aspe municipal swimming pool during the summer of 2021. The First Division court approved the sentence unanimously following a pre-trial agreement between the prosecution and the defense at the start of the trial. Although initially facing a six-year term, the defendant admitted the facts at the oral hearing after the agreement and was sentenced to two years, one year for each offense.
The court also granted a stay of execution, meaning the imprisonment will be suspended unless the defendant commits another crime during the probation period. The defendant, identified as a Senegalese national with no prior criminal record before these events, is ordered to compensate each victim. The court set damages at 2,000 euros for each minor, with payments scheduled in monthly installments of 250 euros.

The incidents took place in July 2021 at the Aspe municipal swimming pool. On July 3, a 14-year-old boy was at the pool when the defendant approached with inappropriate intent, touching him and making unwanted advances. Nine days later, on July 12, the defendant is alleged to have committed a similar inappropriate act against a 12-year-old girl.
Beyond the prison sentence and the compensation ordered by the Alicante Provincial Court, the defendant is prohibited from visiting locations frequented by the victims or the Aspe pool for three years. After serving the prison term, a seven-year probation period will begin, during which he will be barred from working in environments involving contact with minors, regardless of whether the probation is served concurrently.
The defendant, who was free at the time of the hearing, admitted the crime and agreed to pay 2,000 euros in compensation to each of the minors.
