Overview of a Murcia case: a 69-year-old man admits sexual aggression and violence

In a case before the Provincial Court, a 69-year-old man from Murcia acknowledged both sexually assaulting a woman and delivering a brutal beating during an early morning when she declined to have sex with him. The man already carries a prior conviction from five years earlier for mistreatment, issued by the Court of Mixed Jurisdiction No. 4 in Molina de Segura, Murcia. That earlier sentence remains a separate, established part of his criminal history.

Under the current proceedings, the man admitted the facts that occurred in 2021 and received a sentence for those actions. Despite this conviction, he will avoid prison time if he does not commit another offense within three years and completes a training course designed to prevent the repetition of sexual aggression behaviors.

Exploited vulnerability

For the offense of sexual assault, he received a sentence of one year and six months in prison; for mistreatment, 40 days of community service were imposed. He is also forbidden from approaching the victim and must pay 200 euros for injuries and an additional 4,000 euros for moral damages.

According to the court’s factual statements, and as admitted by the defendant during the hearing, the two met through a mutual friend. The woman faced clear vulnerability: she was a foreigner with limited Spanish, attended trial with an interpreter, was unemployed, and had no immediate family in the Murcia region, with children living in Morocco.

The man offered help with the children and a place to stay, and she accepted because she had few ties in the community at that time.

Just three months after meeting and already living together, the man pressured the woman to have sex against her will. There was no documented evidence of intercourse at that moment, driven by fear that he would evict her from his home due to her lack of family support or work in Spain.

Thrown from the bed

The following month, in the early hours, the couple slept in the same bed. When he woke and tried to have sex again, she refused. The man, angered by the refusal, shook her by the neck and dragged her from the bed. Once on the ground, he delivered several blows to her face, grabbed her by the hair, and forced her to leave his house. The assault continued in various forms beyond that moment.

After the attack, the victim escaped, received medical attention, and was later examined by a forensic physician who diagnosed post-traumatic stress disorder connected to the incident. The case highlights the severity of the violence endured and the lasting impact on her wellbeing.
