He also recalls that the reverse process had already been announced in the Botany II Government agreement and has had years to prepare for the concession end and to inform concessionaires about the varied procedures required. Although a routine pass had been anticipated, the association points out that requests for information and documentation began days ahead of the concession’s expiration. The association argues that the current haste reflects a lack of foresight and draws a contrast with other reversal efforts undertaken by the regional government, including those related to the health sector.

The sector stresses the concessionaires’ absolute willingness to provide information and documents as needed, provided they are available and compliant with current legislation. They call on the Administration to demonstrate due diligence and prudence, and warn that haste prompted by insufficient planning should not be shifted onto franchised operators, nor should it threaten sanctions or legal action.

In the letter, Pérez asserts that concessionaires reserve the right to challenge all administrative transactions and decisions deemed unlawful through all available legal channels. A specific example cited is the request that concessionaires negotiate and contract with third parties to supply services to the recently formed public company during a period when management responsibility may be transitioning away from the association’s representation.

The core objective, they explain, is not at odds with respecting the law, following legally prescribed procedures, and upholding the principles of legitimate trust, good faith, and sound administration.
