A 36-year-old man in Alicante has been sentenced by the Provincial Court to twelve years and six months in prison for abusing his partner, subjected to degrading treatment including insults such as “drain rat” or “wretch,” and for sexually assaulting her against her will in the family home where they lived in Novelda.
Issued by a panel from the First Section, the ruling acquits the defendant of three other abuse charges brought against him, two related to gender violence and another in the family sphere, after the court found there was insufficient evidence for those crimes.

No doubt remains that the accused subjected his partner to degrading treatment, repeatedly hurling insults like “drain rat,” “wretch,” “gypsy of filth,” or phrases such as “you should die” or “you do not deserve to live.”
In addition, the court found proven that the man also struck the woman, threw objects at her, and confined her to a room for hours as a form of punishment.
That conduct began when the victim became pregnant and the couple moved to the family home of the defendant in Novelda, living with another daughter from the woman’s previous relationship. The pattern persisted until 2018, when she reported the abuse to the Civil Guard.
Similarly, the sentence concludes that there were at least three episodes during that period in which the defendant sexually assaulted the woman.
The judgment holds the defendant responsible for a habitual abuse offense, for which he was sentenced to two years in prison, and for a continued act of sexual assault, for which an additional ten years and six months were added. The court also ordered a restraining order prohibiting contact with the victim at a distance greater than 300 meters for fifteen years, and an indemnity of 10,000 euros for moral damages, plus another 1,000 euros for the defendant’s daughter. The ruling remains appealable before the Regional Court (TSJCV) within ten days.
