Leaving the scene of the accident to take the victim to the hospital is only possible in areas where ambulance facilities are limited. However, even in this case, you must first contact the duty station and report the accident. explained – auto lawyer Dmitry Slavnov, in a conversation with the Public News Service.
Previously in the Supreme Court of the Russian Federation reportedThe driver could leave the scene of the accident if he helped transport the victim to the hospital and there was no other way to transport the injured person to a medical facility. The expert called for clarification of all the nuances of this assumption.
“If there is a serious accident, we call the road patrol officers and therefore the ambulance. Moreover, the ambulance is our priority, because only doctors have knowledge about how to transport a “seriously” injured person, the lawyer said, adding that in any case, the ambulance will reach the hospital faster.
The driver may hurt the victim while trying to take him to the hospital alone. This option is possible only if the accident occurred far from settlements. In this case, you need to report the accident to the duty station and, after delivering the victim to the hospital, return to the scene of the accident and record what happened to the traffic police.
“If the driver did not call anyone, did not report the accident and simply drove away, this will already be considered hiding from the scene of the accident,” Slavnov explained.
The automobile lawyer concluded that unscrupulous drivers may take advantage of leave to save accident victims, so it is better not to extend such a measure.
