In Russia, a new fraudulent scheme was revealed, where buyers are offered to pay for a car and promise to return the car “when the transaction is completed”.
The attackers work in pairs: first, a “manager” is sent to a meeting with the buyer, who agrees on a price, looks at the car and other nuances, then a “seller” comes to the transaction and concludes a sales contract with the client.
The buyer is requested to transfer money to the “manager”, after which he is assured that he can collect the car immediately “once the transaction is completed”.
It is clear that the victim will not see the money or the car. The “seller” declares that he “doesn’t know” the “manager”. And a person is in a situation where he transferred money to a third party and cannot prove that the car seller received the money.
Lawyer Ekaterina Soldatova noted that it is extremely difficult to recover the car from the seller, despite the fact that the contract is “closed, so to speak.” The buyer can only turn to the court with a claim against a third party for recovery of unjust enrichment.
