A St. Petersburg resident received almost 50 million rubles in a consumer protection case against Ellada Intertrade after persistent car faults in a Genesis G90 faced unfixable issues.
The case, documented on the Telegram channel of the city courts joint press service, concerns a 2018 Genesis G90 bought in 2021 under a four-year warranty. In the third year of ownership, the owner reported several defects: rear seat adjustment buttons failed, the airbag warning light activated, and problems with opening the trunk both with the key and a manual button.
The vehicle underwent repairs at an authorized service center for 35 days, yet the seat adjustment issue recurred following the initial fix. After returning to the dealership and being offered another long repair wait, the owner pursued legal action to recover the value of the goods. The consumer protection lawsuit sought remedies for ongoing vehicle defects and associated losses.
During the proceedings, the Kirovsky District Court ordered Ellada Intertrade to reimburse the owner for several categories of losses. The court awarded approximately 3 million rubles for the vehicle cost, about 11 million rubles for the depreciation difference following the market value changes, and more than 24.2 million rubles for other damages tied to the malfunction experience. Additionally, 50 thousand rubles were granted for non pecuniary damages, along with costs for inspections, taxes, and agency services. The total sum recovered by the court reached about 49.8 million rubles.
The decision highlights the rights of consumers to seek redress when a vehicle fails to meet expected standards and when repairs fail to resolve persistent issues. It also underscores the role of the court in evaluating loss components beyond the initial purchase price and in accounting for inconveniences and non monetary harms in consumer disputes.
