The Russian Federation (Minzifra) discusses the likelihood of abolishing companies that investigate their personal data leaks from the criminal responsibility of the Ministry of Communication, Sector Representatives and related departments of digital development, communication and mass communication. According to the preliminary version of the amendments to the Penal Code and the Personal Data Law, the criminal article may not apply to specific organization categories for the illegal storage of the data obtained. This will affect the organizations engaged in investigations to jeopardize large IB companies and customers’ knowledge.
The current legislation introduced in December 2023 is punished for illegal use, transfer, collection or storage of personal data. Punishment may contain fines, forced employment or imprisonment of up to four years, and a cross with serious consequences up to ten years. The attempt to withdraw investigations from the criminal obligation is discussed with the participation of the Great Data Association (USA) by combining the largest Russian technological and financial companies on the Minzifra site.
