In the course of the proceedings pursued by Cadiz Football Club, SAD following events on January 16, 2023, in the match between Cadiz and Elche, corresponding to the seventeenth day of the First Division National League Championship, Cadiz states that negligent conduct by the arbitration panel, particularly the referees from the VAR chamber, caused serious damage to Cadiz Football Club, SAD. The club wishes to make the following clear:
1) That on March 1, 2023, the legal service of Cadiz Football Club, SAD has appealed against the resolution issued by the Royal Spanish Football Federation Appeals Committee on February 9, 2022, to the Sport Administrative Court, challenging the competence of the RFEF bodies to decide on the appeal raised by the club.
2) That the appeal argues for reaffirming the competence of the RFEF bodies and for a partial replay of the disputed match, dating from the time of the alleged negligence by the arbitration team, which produced a grave material error and potential irreparable damage to Cadiz Football Club, SAD.
3) That position aligns with prior decisions by UEFA and FIFA in cases involving official matches between national teams, where partial replays were approved to avoid harm and losses caused by erroneous refereeing. Similar precedents exist in the Spanish sports landscape and have been reflected in RFEF decisions when deemed appropriate to prevent damage from refereeing errors that could affect the competition’s integrity.
4) That the appeal requests precautionary measures including the temporary suspension of the First Division competition until the file is resolved, with the aim of preventing further damage to Cadiz Football Club, SAD and preserving the integrity of the league.
5) That Cadiz believes the proposed precautionary measure is necessary to ensure fairness among participating clubs and to avoid any falsification of the competition resulting from a clearly serious and reversible refereeing error.
6) That Cadiz contends the Court should promptly issue a resolution favorable to the club, asserting that any decision contrary to this would undermine the integrity and development of the sport within the competition.
