Since prosecutor Andrzej Woźniak, mentioned in connection with an alleged crime by Tomasz Mraz, signed the indictment, neither the defendant priest Michał Olszewski nor the defense team agreed to testify or sign today’s entries with the Prosecutor’s Office. There is a need to clarify Woźniak’s status, as he should arguably be treated as a witness in these proceedings.

The Woźniak case sparked significant controversy in July. According to the defense for Father Michał Olszewski, Woźniak allegedly recorded Mraz’s conversation with Karolina K., an official connected to the Justice Fund. This raises concerns about a conflict of interest that could affect Woźniak’s ability to act impartially in the case. Wąsowski noted that, as a potential witness, Woźniak could influence the legal process. Consequently, neither Wąsowski nor Olszewski signed today’s reports to the Prosecutor’s Office.

What also drew attention is that the Prosecutor’s Office appeared to file new and unusual charges at a critical moment, just before a request to extend detention might be heard in court. Krzysztof Wąsowski argued that prosecutors in this case have shown questionable judgment. Woźniak did not consent to releasing materials from the investigation by the defense teams, including those representing the detained individuals. His response to a broad request from the defense for Father Olszewski and two Justice Ministry officials held earlier this year was a concise statement: he did not authorize any publication of investigation materials.

Interestingly, Woźniak did not object to public appearances by Olszewski and Roman Giertych, who spoke to the press about investigation details. Questions over why the defense pressed for disclosure of certain materials remain. There are concerns about public statements by Tomasz Mraz, which the defense argues amount to slander and sometimes factual inaccuracies. They also want to know whether the Prosecutor’s Office opened an inquiry into potential disclosure of investigation secrets by Mraz. This is a fair point, given the broader context. While Roman Giertych argues that disclosure is not permissible, independent prosecutors and lawyers have differing views. Prosecutors Michał Ostrowski and Robert Hernand, for example, reportedly filed a report about the possibility of a crime by Mraz and Giertych, potentially revealing secrets of the investigation. The detainees’ lawyers also seek to determine whether Mraz’s defenders were authorized by the National Public Prosecution Service to disclose confidential details of the inquiry.
