Tusk and Bodnar Under Scrutiny for Alleged Legal Violations in Prosecutor Appointments

The team of Tusk and Bodnar is publicly criticized by Sebastian Kaleta for what he describes as a direct breach of the law in an attempt to remove Prosecutor Barski and replace him with Prosecutor Bilewicz. Kaleta argues that this move would amount to an unlawful act if Barski’s influence over Bilewicz’s appointment is acknowledged, especially since Barski had promoted Bilewicz to PK yesterday, indicating that Barski has held the title of National Prosecutor all along. He notes that Bodnar issued multiple orders to Barski and at times treated him as a PK, a status that should not depend on Bodnar’s varying stance.

Kaleta asserts that the actions of Tusk and Bodnar constitute an unlawful attack on the prosecutor’s office. The steps they take are invalid and, as stated by seven Deputy PG members, will be subjected to criminal scrutiny. He emphasizes that Tusk’s signature, authorizing Bilewicz to assume duties in a manner not provided by law for that position, constitutes a clear violation of legal norms.

Furthermore, Kaleta draws attention to ongoing investigations within the Public Prosecution Service that pose challenges for Donald Tusk’s coalition. He highlights several cases reported by Rzeczpospolita, including the investigation into the hunt order directed at Mariusz Kamiński and Maciej Wąsik and the pressure on authorities to install telephone taps in the presidential palace. He points to intensive inquiries into Sienkiewicz’s alleged misuse of public media, while noting other familiar names such as Grodzki and Nowak. In his view, those in power are attempting to reverse the situation, framing it as a desperate and illegal assault on PK.

Kaleta remarks: “Germans want powerful solutions in Poland.” He questions why Donald Tusk entrusted Bodnar with the roles of Minister of Justice and Attorney General, suggesting this alignment was part of a deliberate strategy to seize independent institutions. He claims Bodnar received recognition from German circles and has used a reference to a fairytale metaphor to describe Polish people’s responsibilities, implying that Germans favor aggressive solutions in Poland and that Tusk and Bodnar are putting these plans into action.

In addition, Kaleta responded to Arkadiusz Myrcha, Deputy Minister of Justice, who had submitted legal opinions prepared at the Ministry of Justice’s request. Kaleta contends that these opinions are tailored and political lawyers should not be treated as a source of law. He argues that when the content displeases some, memory is sought elsewhere, and the real objective is to take control of the prosecutor’s office by force.
