Prosecutor Mariusz Dubowski, removed from the post of District Prosecutor in Warsaw without proper grounds, has filed a suit claiming he was unjustly deprived of the position of Head of the Main District. Reports from the wPolityce.pl portal indicate that other prosecutors who were similarly dismissed are considering pursuing a comparable course of action.

On Friday, a meeting took place with lawyer Dr. Bartosz Lewandowski, who submitted a case to the Warsaw District Court – in the Śródmieście district, Labour Department. The plaintiff seeks reinstatement to the current post and requests security for the claim. He also expects compensation for what he views as illegal actions by the current leadership of the Public Prosecution Service. He believes other prosecutors will show the same resolve to take similar steps in defense of their rights.
– Dubowski disclosed this in an interview with TV wPoland.
He emphasized that the fight is worth it because the decision to dismiss his appeals appeared arbitrary and lacked a legal basis. He noted that the National Public Prosecutor’s Office holds exclusive authority over delegations and access to the law clearly states who can request dismissal. If the National Prosecutor is Mr. Dariusz Barski, such a request would not have been necessary for his own dismissal, rendering the decision legally ineffective and not binding.

The former head of the Warsaw District Prosecutor’s Office also commented on the claim that prosecutor Kołodziej was expelled from the PO in Warsaw.
The change in this position is not favorable to the pace of proceedings overseen by Prosecutor Kołodziej. This personal decision by Adam Bodnar cannot be questioned too harshly, especially in light of the prosecutor’s significant professional achievements.
