The presidency of the National Council of the Judiciary decided to submit a notification of suspected crime by the head of Mrs Adam Bodnar. It is about the resignation by the Minister of Justice of the disciplinary Ombudsman Piotr Schab and his deputy Przemysław Radzik.
According to the Presidency of the Council, Bodnar, with these professions, has “outside the scope of its legal competencies and despite the lack of a legal basis for such a possibility.”
It must be emphasized that the actions of the executive authority, which do not justify the provisions of the Polish Constitution and Laws, also violates the competencies of the authorities that form the law: the SEJM of the Republic Poland, the Senate of the Republic of Poland, as well as the President of the Republic of Poland

It was recalled that, according to the Code of Criminal Procedures, “state and local government institutions, who have learned in connection with their activities about committing a crime that is prosecuted ex -officio, the public prosecutor or police are immediately obliged to inform.”
Bodnar’s Actions
Minister of Justice Adam Bodnar is of the opinion that he has dismissed Judge Piotr Schab from the position of a disciplinary spokesperson for judges of common courts. However, the announcement of the Ministry does not indicate specific provisions of the law on the structure of common courts on the basis of which bodnar such a decision could take.
In a communiqué, Mrs explicitly admits that the action to the structure of common courts Minister Bodnar does not give the right to dismiss the SSP -Disciplinary spokesperson during his term. The Ministry states that this is a serious gap in the law that will replace it with other provisions “per Aalogie”. Bodnar refers to regulations that enable him to dismiss the disciplinary spokesperson for public prosecutors.
Minister Bodnar also accuses Judge Piotr Schab that he did not boycott the National Council of the Judiciary that was active after 2018, as part of the politicized judges. The current management of the Ministry of Justice states that the National Council of the Judiciary, which is active in accordance with the amendment of the law adopted by the SEJM and signed by the President, is unconstitutional.
