“Bodnarowcy” presented a scandalous project about verification of judges! Some judges threaten in practice to throw out of the profession

The Ministry of Justice Managed by Adam Bodnar published a bill, which is said to restore the constitutional order to the judiciary, mainly regulating the status of judges of 2018-2025. If the project came into effect, it would actually cause legal chaos and throw some judges out of the profession who do not like “bodnarists”. Now the project has the opinion of the Venice Commission.

According to Vice Minister of Justice, Dariusz Mazur, the Project Project is “precedent on an international scale” and the planned law is supposed to remove the effects of “destruction of system guarantees of the independence of the Polish judiciary”. “

Scandalous re -verification of judges

According to the project, the judges who were prescribed in 2018-2025 after the assessment “by the unconstitutional national court register” can participate in repeated competitions that “will have an open formula, and their result will be subject to control over the Supreme Court.”

While MS has passed – people who came to the judicial appeal of other legal professions in these years “as a result of participation in competitions before unconstitutional KRS” returns to their earlier competitions – as long as professional companies accept them. These people will also be able to become referends. This can even mean that many people from the profession of a judge.

Published solutions were given in an opinion of the Advisory Authority of the Council of Europe, ie the Venice Commission.

The speech of the Ministry of Justice to the Venetian Commission is a consequence of the earlier request of the Monitoring Commission of the Parliamentary Assembly of the Council of Europe
