Judge Schab in the European Parliament revealed how the rule of law is being violated in Poland! “Judges of free Poland are (…) forced to pay tribute to the authorities”

A debate was held at the seat of the European Parliament in Strasbourg, presenting how the December 13 coalition violates the rule of law. “Judges are divided into categories depending on the environment they come from. It is said to be about the nomination process, which has been going on since 2018. In fact it is about the war for Poland. It’s about the war between environments. The point is whether the company will remain stuck in post-communism or not,” warned Judge Piotr Schab, chairman of the Warsaw Court of Appeal and disciplinary spokesman for judges of ordinary courts.

My performance in office was met with action from the Ministry of Justice and the police. Thirty armed police officers with crowbars burst into my office to destroy the armored cabinets in my office, take out the files and deprive me of the opportunity to work, because the judges to whom these files related were connected to the current ruling camp .

– said Piotr Schab, addressing the participants of the debate organized by the Group of European Conservatives and Reformers and Patriots for Europe. As part of the event, Members of the European Parliament were shown, among other things, the film “Takeover”, directed by Marcin Tulicki, which presents how the coalition illegally took over the public media on December 13.

Judges are called upon not to apply the Constitution by the authorities issuing illegal resolutions containing threats against judges in a situation where they decide to apply laws instead of the political will of the people currently in power. Judges are divided into categories based on the environment they come from. It is said to be about the nomination process, which has been going on since 2018. In fact it is about the war for Poland. It’s about the war between environments. The question is whether the company will remain stuck in post-communism or not. Judges of free Poland, who do not derive the conditions of their office from dependence on the post-communist system, are on the one hand forced to pay – please forgive me – a tribute to the executive power, because they are called to publicly humiliate themselves by to de facto withdraw from work that bears the hallmarks of independence of judges, and to express words of loyalty to the executive. On the other hand, they are deprived of the opportunity to work by publicly relegating them to the second or third category of judges, because they do not have the right to decide important cases. Such judges are called contemptuous by the executive; I will not quote these statements

– Judge Schab continued.

“‘I am publicly insulted’

I am publicly insulted and robbed of my moral title to work. Me and 3.5 thousand of my colleagues who do their work as best as possible. We are dealing with a situation in which judges are explicitly asked not to apply the rulings of the Constitutional Court. This court in Poland does the same as courts in the Czech Republic, France, Italy or Germany. It sets the limits of states’ sovereignty

– he pointed out.

To destroy the boundaries of state sovereignty, because this is the truth, the executive, but unfortunately also the legislature, is doing everything it can to torpedo the work of the Polish Constitutional Tribunal. Judges are urged not to apply the Constitutional Court’s rulings and are publicly threatened with liability if they do. The rulings of the Constitutional Court are not published and judges are insulted

– he added.

Judge Schab presented how the role of the Supreme Court is being reduced.

Likewise, there has been a brutal downsizing of the Supreme Court. The court plays an extremely important role, including when it comes to confirming the validity of elections. The Supreme Court must be reduced in size in a way that the most important people in the country openly say will eliminate the possibility of validating the elections (…). This is how anarchy is built in the Polish state. I want you to know. So we are dealing with a situation where judges of free Poland are denied the opportunity to perform public services. Secondly, the non-binding Constitution of the Republic of Poland is openly discussed. Third, the leading organs of the Polish state, the Supreme Court and the Constitutional Court, are being systematically destroyed

– he emphasized.

This is evident from the fact that the state budget, the Constitutional Court and the Supreme Court have run out of money. This is how my country’s authorities, who safeguard its sovereignty, are treated
