I KZP 24/3 is not the national prosecutor and cannot prepare and submit these types of requests,” Bartosz Lewandowski, lawyer for Marcin Romanowski, wrote on the X website.
Attorney General Adam Bodnar has submitted a request to the Parliamentary Assembly of the Council of Europe to waive the immunity of MP Marcin Romanowski.
According to lawyer Bartosz Lewandowski, a possible waiver of immunity cannot lead to further actions by the public prosecutor’s office.
A possible waiver of immunity by the ZPRE cannot constitute a basis for the Public Prosecutor’s Office to take action against MP @MarcinRoma19996 due to the ineffectiveness of the waiver of immunity by the Sejm of the Republic of Poland on July 12, 2024. Request for authorization from the Sejm of the Republic of Poland to hold the Member of Parliament criminally liable and to detain him and the temporary arrest, was signed by Prosecutor Dariusz Korneluk, who, in light of the Supreme Court Resolution of September 27, 2024, ref. no. I KZP 3/24 is not a National Prosecutor and cannot prepare or submit these types of requests. The entire procedure therefore contains a significant legal defect that leads to the invalidity and ineffectiveness of the resolutions
