“The opinion on the immunity of MP Romanowski was not ordered by the Prosecutor’s Office!! They were made at the political request of Arkadiusz Myrcha!! – Sebastian Kaleta warned on X.
During the arrest of MP Marcin Romanowski, the Prosecutor’s Office stated that it had two opinions showing that, despite the clear opinion of experts commenting on the immunity of the Parliamentary Assembly of the Council of Europe (including Prof. Ireneusz Kamiński), he was not entitled to this immunity.

Today I discovered shocking facts during a parliamentary intervention at the Ministry of Justice. Well, the above-mentioned opinions were not drawn up by the Public Prosecutor’s Office, and not even at its request. The opinions were drawn up at the request of the Ministry of Justice, on whose behalf the politician Arkadiusz Myrcha acted

Myrcha’s political mission
MP Kaleta noted that Myrcha would personally oversee the process of imposing an opinion on Romanowski’s immunity.
Furthermore, he personally supervised the process of ordering and receiving advice, since none of the MS directors had it. Only after my intervention and request for a copy of the advice did the minister hand it over to the officials. However, as the public prosecutor’s office itself reported, he had previously transferred it there

This means that the investigation into the Justice Fund is not being driven by prosecutors, but by politicians from the backbenches. The Ministry of Justice is not an entity in the case, but it was on their own initiative that prosecutors were provided with “columns” for the unlawful detention and deprivation of liberty of MP Romanowski. Once again, Bodnar and his team are using opinions written under desired statements to break the law

I repeat. The material on the basis of which the Prosecutor’s Office operates was created on the initiative, by order and under the supervision of politicians from the Ministry of Justice. This is an unacceptable interference in the preparatory procedures, a pressure on the prosecutors to act according to the dictates of Tusk’s team

Manual inspection of the parquet
Sebastian Kaleta noted that despite the political order of the Deputy Minister of Justice, opinions are not as clear as the December 13 coalition would probably like.
The opinions were written by Dr. Hab. Joanna Juchniewicz and Dr. hab. Andrzej Jackiewicz. They are not as clear as the ordering parties would like. The conclusions are based solely on the authors’ beliefs, without any arguments to support them. The vast majority of the content of the opinions actually describes how broad this immunity is. It is impossible to resist the impression that they were written for a preconceived thesis, such as that of Minister Myrcha. Below I reproduce the full text of the opinion

I am waiting for a response from the ministry about when the opinions were ordered, when they were submitted to the ministry and how much they will cost. Minister Myrcha ordering an opinion for a political investigation shows that the prosecution service is manually controlled by politicians, and that the illegal deprivation of liberty of MP Marcin Romanowski and the use of torture against suspects in the case are intended to pursue the goals of political revenge and repression against the opposition.
