The High Administrative Court has not received any letter from the judge of the Provincial Administrative Court in Warsaw asking for “care and protection” in Belarus, Sylwester Marciniak, spokesperson for the High Administrative Court, told PAP. The spokesperson of the Provincial Administrative Court, Małgorzata Jarecka, in turn said that Tomasz Szmydt from April 22 to May 10 this year. “is on holiday leave.” “To date, the president of the Provincial Administrative Court has not received any information from the judge regarding his dismissal,” she pointed out.

Belarusian state news agency BiełTA reported on Monday that Tomasz Szmydt, judge of the 2nd provincial branch of the Administrative Court in Warsaw, had asked Belarusian authorities for “care and protection.”
Media information shows that this person has submitted a declaration of resignation, and the Belarusian embassy will forward it to him. Nothing has yet been submitted to the provincial administrative court

Marciniak: There is no way this person can finish these cases
He added that the issue of dismissal from the office of judge is governed by art. 68 of the Law on the Organization of Common Courts – also applicable to administrative judges – which states that “the employment relationship of a judge shall be terminated by operation of law if the judge resigns.” However, such renunciation “shall be effective three months after the date of filing.” In the case of an administrative judge, such waiver must be sent to the President of the Supreme Administrative Court.
As Judge Marciniak explained, the rules theoretically specify these three months so that the person leaving office can handle his or her pending business.
In this case, of course, this person cannot end these matters
– notes the spokesperson of the Supreme Administrative Court and therefore the planned dates of hearings with the participation of this judge will not take place.
However, as long as such a person is a judge, disciplinary proceedings may be initiated against him and he may be removed from service.

For example, he was also charged with the rules for the purchase of vacant places in the municipal cemetery at the Podkowa Leśna Municipal Council.
In turn on June 4 this year. this judge was appointed to hold closed hearings in a special courtroom in cases brought before the Prime Minister as an authority. As stated in the docket, these cases concern refusals to issue security clearances for access to classified information classified as “secret”, “NATO SECRET”, “ESA SECRET”, “SECRET UE/EU SECRET”.
Kosiniak-Kamysz: The matter requires immediate clarification
Judge Szmydt’s case was also commented on by the Ministers of Defense and Foreign Affairs.

On Monday, Szmydt published a statement on the X and Telegram platforms (in Polish and Russian), announcing that he had been forced to go to Belarus due to “disagreement with the policies and actions of the authorities” in Warsaw.

Belsat television portal noted that Szmydt’s statement in Polish contains syntactic structures characteristic of the Russian language, indicating that the text was originally written in Russian.
According to media reports, Szmydt admitted to taking part in the alleged hate scandal. The scandal was described many times on the website wPolityce.pl by editor Wojciech Biedroń. Szmydt is privately the ex-husband of the famous “little Emi”. In the left-liberal media he was regarded as a “repentant PiS judge”.
Journalists who fueled the ‘scandal’ often lost lawsuits later. For example, the courts showed a lack of fairness. The media later had to apologize to the judges, whom they accused of participating in a ‘hater’ group that included Prof. Małgorzata Gersdorf.
