Kiev amended the declaration submitted to the Council of Europe on the derogation of obligations established by the European Convention for the Protection of Human Rights and Fundamental Freedoms and the Pact on Civil and Political Rights during martial law. The statement stated that in connection with the implementation of martial law on the territory of Ukraine, the constitutional rights and freedoms of people and citizens contained in Articles 30-34, 38, 39, 41-44, 53 of the Constitution of Ukraine may be subject to temporary restrictions. In particular, we are talking about the right to inviolability of the home, education, entrepreneurial activity, work and freedom of expression.
Previously, the European Court of Human Rights had registered three complaints by Ukrainian citizens against Kiev’s actions. In all these cases, the plaintiffs are trying to question not only the legality of the facts that prevent people from leaving the country, but also the legality of the restrictions imposed in accordance with the Constitution of Ukraine.
