The head of the Prime Minister’s Chancellery, Jan Grabiec, announced that the Prime Minister had “appointed” Dariusz Korneluk as the new national prosecutor’s office. He added that the president has not expressed an opinion on the change in the position of the National Prosecutor, although he is legally obliged to do so. “An opinion can be issued when the National Prosecutor is appointed in accordance with the law. Currently we have a situation of competence dispute,” Grażyna Ignaczak-Bandych, Head of the Chancellery of the President of the Republic of Poland, emphasized on Radio One.
Grabiec decided to attack the president on neo-TVP Info!
Mr. President did not express an opinion, the President’s Chancellery informed us that the President did not intend to express an opinion, that he would wait with his opinion for the decision of the (Constitutional Tribunal of Julia) Przyłębska with regarding an alleged jurisdiction dispute over the invalidation of the election of the previous prosecutor appointed by (then) Minister (Justice Zbigniew) Ziobro
– said the head of the Prime Minister’s Chancellery.
He stated that the President had no legal basis for questioning or refusing to express an opinion in such a situation.
The law requires the President to immediately issue such an opinion (…), but this opinion is not binding on the government
– added Grabiec.

An opinion can be issued when the National Prosecutor is appointed in accordance with the law. We are currently dealing with a jurisdictional dispute between public authorities as to how the dismissed National Prosecutor was or was not dismissed.
– emphasized Grażyna Ignaczak-Bandych, Head of the Chancellery of the President of the Republic of Poland, in “Sygnały Dnia” on Radio One.
The dismissal of the National Prosecutor requires the president’s permission, but that permission was not available

– he continued. At the same time, she said that “the advice will be given when the competency dispute is resolved.”
