The head of the Prime Minister’s Chancellery, Jan Grabiec, said the presidential palace would receive a request for advice on the candidate for national prosecutor within the next few hours. I hope the president will not delay here, he added, apparently because he wants to hound the head of state. At the same time, the minister stated that for the appointment of a new National Prosecutor… it does not matter whether the president’s assessment is positive or negative. That’s just guts!
Tusk’s government wants to ignore the president’s opinion!
Grabiec said on TVN24 that he is counting on the quick appointment of a national prosecutor – an illegal prosecutor, let’s not forget that! The head of the KRPM emphasized that the president must express his opinion on this issue.
A request for advice will be submitted to the presidential palace in the coming hours. I hope the President will not delay here
– he said. Is this rushing the head of state?
Grabiec also stated that it does not matter whether the president’s opinion is positive or negative about the appointment of the new national prosecutor.
Let us recall that in accordance with the Law on Public Prosecutions, “the National Prosecutor, as first deputy of the Public Prosecution Service, and the other deputies of the Public Prosecution Service, not exceeding seven in number, shall be appointed from among the prosecutors of the National Prosecutor’s Office and dismissed from these positions by the Prime Minister at the request of the Attorney General.”
The National Prosecutor and other deputies of the Prosecutor General shall be appointed upon the advice of the President of the Republic of Poland and shall be dismissed with his written consent.

The president won’t issue any advice at all?
There is an ongoing competency dispute on issues related to the office of the National Prosecutor. The case was referred to the Constitutional Court and, in accordance with the Law on the Tribunal, all activities had to be suspended for the duration of the competency dispute. If action is taken, the president will have a clear answer. They are illegal and against the law
– Piotr Ćwik, Deputy Head of the Chancellery of the President of the Republic of Poland, told PAP at the end of February.
When asked whether the president should issue an opinion on this, the presidential minister replied:
He is not allowed to issue an opinion as the matter is pending before the Tribunal and the jurisdiction dispute is still ongoing.
When asked by PAP whether this meant the president would not issue an opinion, he replied that “this is how it should be understood.”
The ‘competition’ farce
Let us also remember that Dariusz Korneluk won the “contest” for the position of National Prosecutor, and the grotesque spectacle was the idea of Adam Bodnar himself. The minister himself admitted to journalists that the competition is not included in any provision of the Public Prosecution Act!
At the same time, former Deputy Minister of Justice Sebastian Kaleta emphasized in an interview with the wPolityce.pl portal that Dariusz Korneluk, “selected” in an illegal “competition” for the post of National Prosecutor, joined the PK together with Adam Bodnar, and shortly ended his delegation to the Ministry of Justice. Does this also confirm that this illegal competition is fictitious?
