Prosecutor Mariusz Dubowski, unlawfully dismissed from the post of District Prosecutor in Warsaw, filed a lawsuit alleging that he was deprived of the position of Head of the Main District. According to information from the wPolityce.pl portal, other illegally dismissed prosecutors are also planning to take a similar step.

On Friday we met with lawyer Dr. Bartosz Lewandowski filed a lawsuit before the Warsaw District Court – Śródmieście, Labor Department. As part of these legal proceedings, we will demand that I be reinstated to my current position. We also request security for my claim. Alternatively, I also expect compensation for these illegal actions from the current leadership of the Public Prosecution Service. I trust that other prosecutors will also have the strength and determination to take such a step (…)

I think it is worth fighting for it, because the decision to appeal our appeals was completely unfair and had no legal basis. The exclusive authority regarding delegation lay with the National Public Prosecutor’s Office. (…) The law clearly defines who can request dismissal. If the National Prosecutor is Mr Dariusz Barski, such a request was not necessary for my dismissal. The decision to dismiss me therefore has no legal force and is not binding

Exile and Pegasus
The former head of the Warsaw District Prosecutor’s Office also commented on the fact that prosecutor Kołodziej was “expelled” from the PO in Warsaw.
The change in this position is not conducive to the rhythm of the proceedings over which Prosecutor Kołodziej supervised. (…). This personal decision (by Adam Bodnar – ed.) cannot withstand criticism, especially considering the enormous professional achievements of the prosecutor. (…)
