On Friday, January 12, the President of the National Notarial Council, Lech Borzemski, sent a letter of faithful submission to Adam Bodnar. As the notary admits, two weeks earlier there was a meeting with the Minister of Justice, in which they discussed the issue of bypassing the court in introducing murder in Poland. Of course, President Borzemski mentioned it differently in his letter, as he mentioned the arrangements:
that could contribute significant reduction of the burden on the courts in non-controversial matters that do not require judicial decisions and which can be handled by a legal protection authority, such as a notary.
LGBT at notary
What should notaries do for judges? The chairman of the National Notarial Council mentions, among other things, public registers (for example regarding inheritances), land and mortgage registers, property matters, but also… civil partnerships of homosexual couples. Borzemski says:
Currently, there is a broad social discussion about the regulation of civil partnerships in Poland, both heterosexual and same-sex relationships. Undoubtedly, some groups in favor of such an arrangement will seek regulations under which such relationships will be registered (closed) at the civil registry.
However, Borzemski is concerned about that
this solution can are difficult to implement for various reasons, social and political.
And here the chairman of the National Notarial Council rushes to help the new government by making proposals
introducing the possibility of entering into partnerships through an appropriate notarial agreement, which, in accordance with legal provisions, would regulate the legal position of partners. In such a situation, these relationships could be registered in a separate register (…).
It is interesting that the Ministry of Justice did not earlier boast about the meeting with the chairman of the National Notarial Council, which is a continuation of Borzemski’s letter to Bodnar. Both men seem to agree on two issues: that civil partnerships between homosexual couples should be legalized in some way, but that the political climate is not favorable for that. And here Lech Borzemski hastens to assure that, knowing these constitutions of prostitutes, problems with laws and with Poland in general, he proposes his Komsomol supporters, i.e. notaries, who will help to circumvent the regulations, or at least a difficult to avoid a debate that will damage the government coalition, because PSL officially does not want to support LGBT people.
Not just Joanna K.
A number of phenomena are noteworthy. First of all, the idea, created with the participation of Adam Bodnar, was to bypass the courts in implementing specific political demands. Does the minister believe that some judges will deny the solutions he has proposed? The second issue is the revolutionary willingness of the leadership of the National Notarial Council to help the government of Donald Tusk in the implementation of party programs. Therefore, it seems that not only Joanna K., notary, has contributed to the violation of the law of the current government (in the attack on the media), but also that some other members of this profession will always, everywhere and even untruthfully to draw. Such servile and obedient cases spoil the reputation of the entire profession.
