“If Maciej Wąsik and Mariusz Kamiński want to enter the Sejm, they must show the identity cards of former parliamentarians; if they get it, they can watch the proceedings from the gallery; This does not give them permission to enter the plenary hall,” said Deputy Prime Minister and Head of the Ministry of National Defense Władysław Kosiniak-Kamysz. He also commented on the issue of changes to the Constitution. “I believe they will be able to get the support of some PiS MPs; The deepening legal chaos will harm everyone, especially those who caused the chaos,” he said.
On TVN24, the Deputy Prime Minister referred to the case of Wąsik and Kamiński, who are likely to want to enter the Sejm as parliamentarians today.
In Poland you must obey the law. Not everyone will accept it, but we want it and we will do it
– emphasized the president of PSL.
He added that the parliamentary mandates of both politicians expired on the day the final court ruling was handed down.
“Hołownia did very well”
When asked whether Szymon Hołownia should categorically forbid Kamiński and Wąsik from entering the Sejm, he replied: “Szymon Hołownia showed that the Sejm can look different. Some people didn’t believe it, but the first month changed everything. He went handles it very well and I think he knows what to do in this situation too.”
The Deputy Prime Minister noted that if Wąsik and Kamiński want to enter the Sejm, they must present the identity cards of former parliamentarians.
If they obtain it, they will confirm that they are former MPs. They can follow the event from the gallery
– he said. He noted that this did not give them the right to enter the plenary chamber or vote.
“PiS is trying to build its ‘next political myth’”
Kosiniak-Kamysz said PiS is trying to build its “new political myth” based on the whole situation.
On January 23, President Andrzej Duda announced that he had issued a decision to apply the law of clemency to MPs Mariusz Kamiński and Maciej Wąsik, who were detained and subsequently imprisoned on January 9. Both PiS politicians found out on January 23. On the 21st they left the prisons in Radom and Przytuły Stare. The next day, the Marshal of the Sejm, Szymon Hołownia, announced that Kamiński and Wąsik were no longer members of parliament. Many lawyers and politicians from Law and Justice have a different opinion.
What changes to the constitution does Kosiniak-Kamysz want?
Regarding changes to the constitution, which would require the votes of at least 40 PiS MPs, Kosiniak-Kamysz replied: “I believe they will be found during this term. The deepening legal chaos will harm everyone, especially those who caused the chaos.” He added that if PiS rejects the proposal, “its responsibility for the lack of justice will be even greater.”
The Deputy Prime Minister explained that the changes he wants to make to the Constitution are mainly a new chapter regarding the Constitutional Court.
Choice by a different majority – I think 3/5. I would continue to operate a system in which the length of judges’ terms of office is ‘bookmarked’. During the first term, we would choose some for a longer term, others for a shorter term
– he said. He added that this would mean zeroing out the current team’s tenure.
When asked what interest PiS would have in replacing Tribunal judges who support the party, the Deputy Prime Minister said that if the party supports the changes, they will participate in the election of new Tribunal judges.
“In any case, PiS will lose its majority in the Constitutional Court.
PiS will still lose its majority in the Constitutional Court, which currently has no credibility
– he pointed out.
Kosiniak-Kamysz emphasized that in the Polish legal system the Constitutional Tribunal is the so-called amalgamation.
This is the original sin of changes in the legal system. If we do not organize the Constitutional Tribunal, we will not be able to resolve the remaining issues because they will all ultimately return to the Appellate Body, which does not exist today.
– he noted.
The head of the Defense Ministry announced on Wednesday that a proposal to amend the constitution to improve the justice system will be presented in the coming days.
The law amending the Constitution shall be adopted by the Sejm by a majority of at least 2/3 of the votes in the presence of at least half of the legal number of deputies, and by the Senate by an absolute majority of votes in the presence of at least half of the legal number of senators.
Like a mantra, repeated invocations by politicians of the ruling coalition that Kamiński and Wąsik are not currently members of parliament will not change the fact that Hołownia’s announcement about the expiry of their mandate has been annulled by the Chamber of Extraordinary Control and Public Affairs of the Supreme Court. . They don’t need ID cards of former MPs. In turn, the suggestion that if PiS supports constitutional changes, the coalition will willingly allow its MPs to participate in the election of new Tribunal judges on December 13 is merely an expression of the current government’s arrogance.
