An attempt to destroy the institutions that shape Polish identity
After Sienkiewicz’s usurpers illegally invaded the public media, the Institute of National Remembrance was targeted. Almost immediately after the parliamentary elections, the coalition led by Tusk raised votes on the liquidation of the institution that returns to Poles the true knowledge of Poland’s history and the memory of those who would be forgotten forever. The government is trying to starve the Institute of National Remembrance by cutting the institution’s budget by almost PLN 70 million, and this is probably only the first step towards its liquidation.
But that’s not the end. The Minister of Culture has been devastated by the subsequent centers that preserve memory and knowledge about the history of Poland and Poland. This center explores the history of Poland and presents figures and events that have shaped Polish identity. After Tusk’s team took power, purges are also being carried out here – the Ministry of Culture and National Heritage refuses to pay public funds to complete the construction of the museum. We are talking about more than PLN 13 million, which would be spent on the construction of the headquarters and the permanent exhibition.
The Ministry of Culture presents these as additional measures. These are not new funds that we are asking for, because the value of the investment assignment has not increased. […] Last year we returned exactly the same amount, with the immediate request to secure this money for the current year. There were important reasons for this. This was due to the fact that the main contractor for the construction of the museum, namely Rafako, postponed the work he had committed to in the contract for the construction of this facility.

RAFAKO SA demands more than PLN 25 million
RAFAKO SA has withdrawn from the contract and is demanding more than PLN 25 million from the “Lux Veritatis” Foundation. The museum “Memory and Identity” opened in October 2023. This was possible thanks to the settlement reached with RAFAKO SA – the company agreed to complete the construction and also remove any defects that had occurred so far. However, the company did not meet its obligations and because RAFAKO failed to meet deadlines, the Museum released a statement taking notice that he withdraws from the contract with the company.
On January 17, RAFAKO announced its withdrawal from the contract and demanded more than PLN 25 million from the “Lux Veritatis” Foundation. The company claims that the Foundation has hindered repair work, which is not true.
As stated in the announcement of the Museum “Memory and Identity”, “the declaration of withdrawal from the contract and the settlement submitted by RAFAKO SA on January 17, 2024 does not have any factual or legal effect, in particular as regards the withdrawal.”
As of January 17, 2024, there is no contract or settlement in legal transactions from which RAFAKO SA could effectively withdraw.. Therefore, the Museum declares that the declaration of withdrawal from the contract and the settlement, filed by RAFAKO SA on January 17, 2024, ineffective and has no legal effectwhich generally applicable legal provisions relate to the withdrawal from the agreement. […] At the same time, the Museum states that cooperated fully with RAFAKO SA and undertook all efforts and actions aimed at the execution of the contract and the settlementtaking into account in particular the socially important purpose of the task and the expenditure of public resources
– wrote in a statement from the Museum of Memory and Identity. Saint John Paul II on the submission on January 17, 2024 of a letter regarding the withdrawal of RAFAKO SA from the contract and settlement concluded with the museum.
Notice of Legal Action
The museum also highlighted that RAFAKO included the following in the publicly available letter: deliberately numerous gross inaccuracies and false statements. In connection with The museum announces that it will take legal action. Legal action will also be taken in connection with the protection of violated personal rights. RAFAKO sent mass communications to the media. The Museum emphasized that these were again based on false and defamatory information about the Museum and its services.
Lidia Kochanowicz-Mańk, financial director of the ‘Lux Veritatis’ foundation, referring to the case on Radio Maryja in the program ‘News of the Day’, pointed out that “the museum’s duty was to transfer the building design, the to transfer land and pay compensation for the work performed. In that respect, the Museum has complied 100 percent.”
She added that the “Memory and Identity” Museum signed an agreement with Rafako from Racibórz on October 13, 2023. The mediation over its signing took almost eight months. The settlement was processed by the Public Prosecutor’s Office of the Republic of Poland.
Under the settlement, the Museum decided it could extend the deadline for construction completion and took over the property on October 13. However, after carrying out an acceptance inventory for the technical acceptance and the final acceptance report, it turned out that the contractor had not carried out this investment properly. There are many flaws and defects (over 2,600). These are both minor and major defects, but the outside company that commissioned the Museum determined that these defects and defects were not defects that would completely hinder the operation of the facility. By signing the settlement, Rafako agreed to remove all defects and defects within the stipulated period, but no later than March 31 this year. Rafako had to draw up a repair plan and schedule so that we knew when and how the defects would be fixed. The main contractor did not do this; did not meet the terms of the settlement, so on December 20 last year The museum was forced to withdraw from both the settlement and the contract
– Kochanowicz-Mańk explained, noting that if the “Memory and Identity” Museum informed Saint John Paul II on December 20, 2023 about his withdrawal from the settlement and contract, which means that on the same day they ceased to exist in legal transactions. She added that it is difficult to determine what Rafako’s January 17 announcement is.

Lidia Kochanowicz-Mańk also drew attention to the fact that the president of Rafako tells an untruth when filing claims against the Foundation “Lux Veritatis” and that the Foundation withdrew from the settlement and the contract.
The party to the agreement is the Museum “Memory and Identity” as a state cultural unit. The Foundation is only a co-organizer, just as the Minister of Culture and National Heritage is a co-organizer on the other hand. In this case, it is difficult to say that the Foundation has withdrawn from the contract and it is difficult to demand financial resources from the Foundation because it is not and has never been a party to the contract. I don’t want to accuse Rafako’s board of directors of doing this on purpose, but it is difficult to say that a professional company with fantastic legal advisors and many people working for the company is confusing the entities that are party to the contract and on which any financial claims can be submitted. Certainly not to the “Lux Veritatis” Foundation.
