Deputy Minister Myrcha answered the Kamiński and Wąsik cases in the Sejm. According to him, both MPs are ‘common criminals’. ‘Minister, where can you find the provision allowing the Supreme Court to verify the pardon granted by the President of the Republic of Poland? Do you know where this recipe is? Nowhere. In no legal act,” replied Prof. Przemysław Czarnek. And then he gave him a short law lecture and made jokes about Myrcha.
On Wednesday, at the request of PiS, the Sejm listened to updated information “about the systematic violation of the Constitution of the Republic of Poland and its basic political principles by the government of Donald Tusk.” This included the illegal takeover of public media, illegal detention and deprivation of liberty of Mariusz Kamiński and Maciej Wąsik, and an attempt to illegally dismiss the National Prosecutor. Myrcha called Mariusz Kamiński and Maciej Wąsik “criminals” and defended the attack on the Public Prosecutor’s Office by Adam Bodnar.
Czarnek made fun of the heads of the Justice Department
Referring to the words of Donald Tusk, who declared during the election campaign that he would apply the law “as he understands it”, MP Czarnek told a joke.
There’s a joke where a tipsy husband comes home at two in the morning and explains to his wife where he was, and she doesn’t believe him, and he says this is my version and I’ll stick to it. The minister has been trained in this lie: this is his version and he will stick to it
– joked about Myrcha Prof. Czarnek, who moments later gave Myrsha a mini-lecture on constitutional law.
Minister, a brief discussion of constitutional law for the doctor, but also for the professor, your boss, who is constantly looking for legal bases. In art. 7, you quoted it beautifully, but you just don’t understand it. It is written that government agencies only act on the basis of legal provisions and within the limits set by that law
– reminded the constitutionalist.
The state has no right to over-interpret legal provisions.
Because there is a rule that belongs to the principles of the rule of law: what is not expressly permitted by law is prohibited
– Czarnek finished the lecture.
