Attorney General Adam Bodnar had every right to resolve the situation at the National Public Prosecution Service, Krzysztof Śmiszek, deputy head of the Ministry of Justice, told PAP. He pointed out that Bodnar’s predecessors, when they restored Dariusz Barski to active duty at the prosecutor’s office, “used a provision that was no longer in effect.”
On Saturday, PiS MP Marcin Warchoł (Sovereign Poland) announced that they had “filed a notice on behalf of the Law and Justice Club against Justice Minister Adam Bodnar and his associates, including prosecutor Jacek Bilewicz.”

According to the Deputy Head of the Ministry of Justice, “Sovereign Poland cannot accept the fact that after October 15, 2023 in Poland we will apply the law and not the law, after considering whether we will bend the law to accommodate specific people to thus to provide for public institutions.”
Śmiszek ruled that Attorney General Adam Bodnar “had every right to resolve the situation in the National Prosecution Service, because Prosecutor Bodnar’s predecessors had probably failed to notice or deliberately used a provision that was no longer in force to restore the lord.” Barski to an active position at the Public Prosecution Service.

On Friday, the Justice Department announced that prosecutor Dariusz Barski’s reinstatement to active duty in 2022 took place without legal basis. According to the Ministry of Justice, this means that as of January 12 this year, because he is no longer on active duty, he does not meet the requirements to be a National Prosecutor and has no longer fulfilled this position since Friday. The Ministry of Justice also announced that Jacek Bilewicz, prosecutor at the National Public Prosecutor’s Office, has become acting National Prosecutor.
According to Deputy Minister Śmiszek, “nothing special is happening”.
