President Andrzej Duda emphasized in a speech delivered on December 31, 2023 that “in a democracy, the constitution, the rule of law and good political habits must be respected.” He also emphasized that he would “never agree to violate the constitution.” Kamila Gasiuk-Pihowicz couldn’t help being sarcastic as in a message posted online, she demanded that the president show specific articles of the constitution that had been violated. Twitter/X users, including politicians, rushed to help the MP from the coalition led by Tusk.
President Duda: There is no permission to violate the constitution
In a speech on the last day of 2023, President Andrzej Duda emphasized that “we are facing a new situation in Polish politics.”
The president and the government come from different political camps. This is normal in a democracy, but in a democracy you must respect the constitution, the rule of law and good political customs. Unfortunately, in recent days, in an attempt to take over the public media, the governing coalition has broken these rules
– emphasized the president.
For the first time in free Poland after 1989, an attempt was made to take over the public media by force. The television signal of some channels was switched off and news programs were no longer broadcast. Finally, TVP, Polskie Radio and PAP were declared bankrupt. I would like to say it clearly: those in power can reform public media, but this must be done in accordance with the law. I have always been open to such discussions about legal changes. However, from my side, there will never be permission to violate the Constitution, and this is unfortunately the situation we are currently facing
– said President Duda.

Gasiuk-Pihowicz asks about the articles of the constitution
Two days after the president gave his speech, Kamila Gasiuk-Pihowicz decided to shine. An MP from the coalition led by Donald Tusk posted a message on Twitter/X asking President Andrzej Duda which constitutional articles he was referring to. She also stated that President Duda had violated “at least thirteen” provisions. However, she did not elaborate on the subject.
I have a question for the president @AndrzejDuda. Specifically: which articles of the Constitution have been violated? Because when it comes to your achievements, you can name at least 13
— wrote Kamila Gasiuk-Pihowicz on Twitter/X.
Twitter/X users respond
Twitter users, including politicians, came to Kamila Gasiuk-Pihowicz’s aid, pointing out which articles of the constitution were violated by the team led by Donald Tusk.
In concrete terms, this is art. 2, 7 and 190 section 1. And all this in two weeks and with an extremely cautious interpretation
– replied Supreme Court Judge Kamil Zaradkiewicz.
Please, at least Art. 7 – The government acts on the basis and within the limits of the law. It was flagrantly violated by Minister Colonel Sienkiewicz by usurping powers clearly assigned by law to another body. P.S. The 13 supposedly broken ones are of course nonsense. Several times in live programs I asked politicians of the then opposition to provide these supposedly contradictory articles. They did not provide one or had to change the content to fit (for example that in Article 187 there is an election of fifteen members from among the judges by the judges, while “by the judges” there is none)
– emphasizes Marcin Horała.
Certainly Articles 2 and 7, and you have now been in power for two weeks. Why this question? It’s very easy to prove that you violated the Constitution…
– said Bartosz Pałucki.
Maybe the MP will satisfy my curiosity and list these 13. Because you have been talking for 8 years about PAD and PiS violating the constitution, but you cannot indicate which.
