We have submitted a request to the President of the Senate Małgorzata Kidawa-Błońska to terminate the senatorial mandate of the Minister of Justice and Attorney General Adam Bodnar – said Marcin Romanowski and Maria Kurowska from sovereign Poland.
At a press conference in Warsaw, Marcin Romanowski, former Deputy Minister of Justice, justified that the request to terminate Adam Bodnar’s senatorial mandate is related to media reports according to which the head of the Ministry of Justice is conducting civil and registration matters related to the change of management in the public media.
Pursuant to art. 103 of the Polish Constitution, a senatorial mandate cannot be combined with the exercise of the functions of judge or prosecutor. It has never happened in the history of Polish parliamentarism that the Minister of Justice, acting as Attorney General, personally carried out activities and took over cases. If such a situation occurred, there was a violation of the law, an abuse of power by a government official, or a violation of art. 231 of the Criminal Code, but if the courts, the public prosecutor’s office and public institutions were to take a different position, it must be assumed that Minister Bodnar has in fact assumed the function of ordinary prosecutor and thus art. 103 in connection with art. 108 of the Constitution and the President of the Senate is obliged to allow the senator’s term of office to expire immediately
– Romanowski stated.
Maria Kurowska announced that the current opposition will watch the hands of the ruling coalition.
Because this coalition, formerly the opposition, went to the elections with slogans that we are violating the rule of law, we are now trying to pay attention to where they are violating the rule of law. When I asked several times where exactly we had violated the rule of law, there was silence on the other side. No one has ever shown where we have violated the rule of law. We have examples like that now, and it’s been quite a two weeks of government
– said Kurowska.
It is time to prevent the current coalition from violating the rule of law
– she added.
Bodnar: “I believe it is my duty to implement the Sejm’s resolution”
On Friday, the head of the Ministry of Justice, Adam Bodnar, was asked in Radio Zet why he, as Attorney General, wanted to take over all investigations related to the management change at TVP, Polskie Radio and PAP. had no authority to take over investigations, so the question itself contained a lie.
These decisions in this regard are taken by the National Prosecutor and the relevant prosecutors. I can only ask for information about what is happening in individual cases. The situation is different in civil cases, because the district courts and regional prosecutors are very involved in this registration procedure. In this respect, in my opinion, decisions can be made by the Attorney General, because the question is to what extent the public prosecutor pursues the public interest in civil, i.e. private, proceedings. I believe it is my duty to implement the Sejm’s resolution
– said Bodnar.
Last Tuesday, the Sejm adopted a resolution on the restoration of rule of law and the impartiality and reliability of the public media and the Polish Press Agency, calling on the Ministry of Finance to take corrective measures. A day later, the Ministry of Culture announced that the Minister of Culture and National Heritage, Bartłomiej Sienkiewicz, as the body that implements the property rights of the Ministry of Finance and acts on the basis of the provisions of the Commercial Code, was dismissed on December 19 . the current chairmen of the boards of directors of Telewizja Polska SA, Polish Radio SA and the Polish Press Agency SA and the Board. The minister appointed new Supervisory Boards, which appointed new boards.
President Andrzej Duda assessed this action as against the constitution; PiS politicians who carried out parliamentary interventions at the TVP and PAP headquarters assessed the situation in the same way.
On Saturday, President Duda announced that he had vetoed the budget law drafted by the new government, which provided, among other things: resources for the public media for the coming year. As the president justified, his decision was related to a “gross violation of the constitution and the principles of a democratic constitutional state” in the public media.
Following the presidential veto, the head of the Ministry of Culture and National Heritage decided on Wednesday to liquidate TVP, Polskie Radio and PAP. The Minister of Culture made a similar decision on Friday regarding 17 regional companies of Polish Radio, which are part of Auditorium 17.
