Draft changes to the regulation Adam Bodnar’s Regulations on the Operation of Common Courts are raising increasing concerns. Arkadiusz Myrcha tried to defend his new boss. Sebastian Kaleta answered him.
In the case of the so-called Robert Gwiazdowski commented on Bodnar’s decree.
So you are saying that the Minister of Justice and the Attorney General can indicate to the judges in the “Regulations on the functioning of the ordinary courts” how they should judge? And PiS idiots passed a number of laws that violated the constitution
– we read in his entry.
His deputy, PO’s Arkadiusz Myrcha, defended the justice minister.
Professor, your shortcut is very misleading. The Member States/PG cannot in any way indicate through the regulations how they should govern. He cannot interfere with decisions made in court. The office regulations are intended to ensure correct and efficient behavior
– He wrote.
Kaleta’s response
Sebastian Kaleta responded to Myrcha’s entry. The MP of Sovereign Poland writes, among other things: about destroying the narrative that the Platform has built up during eight years of PiS rule.
Exactly, he can’t. It’s just that your new boss wants to make rules without a law to force him to do so. It was supposed to be apolitical and impartial, the restoration of the rule of law, etc. And it turns out you’re starting your government with a monkey-with-a-razor-like action. Your entire story, built up over eight years, destroyed in a few hours. This further demonstrates that your accusations against us were false, because you yourself are acting in a way that is easy for a first-year law student to assess. Because we never proposed such legal tricks. Fortunately, judges will not be bound by this regulation, because according to the constitution they are subject to the constitution and statutes, and not to #Bodnar’s decree
– we read in his entry.
