Senior Marshal of the new Sejm and PSL MP Marek Sawicki mentioned in an interview with “Dziennik Gazeta Prawna” the possibility of introducing a constructive vote of no confidence against the government of Mateusz Morawiecki to end the procedure of the so-called first constitutional step . This idea was picked up by TVN24 journalist Konrad Piasecki, who stated that there were no constitutional obstacles to using this solution. However, many other commentators – including journalists who were highly critical of PiS – presented a very different view.
If Mr Morawiecki submits the resignation of the current government – either to me as senior chairman or to the newly elected chairman of the Sejm – and gets an appointment from the president, then the new chairman, according to what constitutionalists tell me , possibly convening a meeting of the Sejm within seven days with one agenda item: a constructive vote of no confidence in the government of Mateusz Morawiecki

There are no constitutional obstacles to such a solution. It is conceivable that this application will be formally submitted after the MPs have been sworn in and before the Prime Minister resigns. And then the new government could start functioning not in December but in the second half of November

A storm on the internet after Piasecki’s arrival
The above submission caused a flood of critical comments, including from journalists who were very critical of PiS.
I am not sure whether a constructive vote in favor of a vote of confidence is possible. Sounds absurd.
However, Konrad expressed more reservations in the commentary on the Constitution of the Republic of Poland, edited by Piotr Tuleya, a retired judge of the Constitutional Court.
It depends who’s watching
You’ve had the constitution on your lips for eight years and you haven’t even looked at it. Another bluff you play against people. Please read the terms in Article 158, and what is its logic? If the government is dismissed during the first session of the Sejm, against whom should such a motion of no confidence be tabled?
You need to know the Constitution of the Republic of Poland, not just refer to it.
Are you proposing a selective application of the law? And where is the Constitution and the procedure described therein in all this?
