The opposition has talked so much about democracy and adhering to the Constitution, and when the interests of this political group are at stake, the values they supposedly cared about and fought for don’t matter at all. Now Michał Kołodziejczak, a new member of the Civic Coalition, has published his arguments on this issue on social media.
Consultation in the presidential palace
On Tuesday and Wednesday, at the invitation of the Head of State, consultations will take place at the Presidential Palace with representatives of the individual electoral commissions that will be represented in the next Sejm. The meetings will take place with each of the election committees separately, in the order according to the results achieved by these committees in the elections.
President Andrzej Duda not only plans to raise issues related to the elections and the formation of the government by convening the first sessions of the Sejm and the Senate, but also wants to “speak on important issues for Poland, both in the international arena and in the most important area”. issues in domestic politics,” the minister said in KPRP Małgorzata Paprocka.
The constitution provides for three possible steps in selecting the government after the elections. In the first it plays a major role the president, who convenes a meeting of the Sejm and the Senate for a day that falls within 30 days after election day. During the first session of the Sejm of the new term, the current Prime Minister must resign, and the President must accept such resignation. A government in a state of dismissal continues to exercise its functions until a new one is appointed.
The president then appoints the prime minister and appoints the government. Until now, it has been common for presidents to appoint people appointed by the party that won the election. When appointing the Prime Minister, the President takes into account that the government he proposes must receive the support of an absolute majority in the Sejm in order to receive a vote of confidence. If the Council of Ministers does not receive a vote of confidence, the Sejm will take the initiative to form the government.
In this constitutional step, a group of at least 46 MPs can nominate a candidate for prime minister. The Sejm elects the Prime Minister by an absolute majority in the presence of at least half of the legal number of deputies. The Head of Government then presents the government’s program of activities and the proposed composition of the Council of Ministers to the Sejm, which is elected by the Sejm by an absolute majority in the presence of at least half of the legal number of deputies. This is a form of giving confidence to the government. The Sejm has fourteen days to elect the prime minister and government.
If the Sejm fails to form a government, the President shall appoint the Prime Minister and, at his request, members of the government within fourteen days and administer their oath. After appointment by the President, the Council of Ministers has fourteen days to obtain a vote of confidence in the Sejm. In this constitutional step, the Sejm grants a vote of confidence to the government by a simple majority vote (an absolute majority is required in the two previous steps) in the presence of at least half of the legal number of deputies.
