From Thursday, August 31, the exemption from the tax on civil transactions (PCB) for the purchase of the first apartment or house will come into effect; this is for the secondary market.
As previously announced by the Ministry of Finance, the exemption of PCC upon the purchase of the first apartment will apply under the Act of May 26, 2023 amending the Law on Municipal Self-Government, the Law on Social Forms of housing, the Real Estate Management Act, the Civil Transaction Tax Act and a number of other laws. The regulations were published July 31 in the Journal of Laws. PCC provisions will take effect one month after the announcement.
The Ministry of Finance has pointed out that the sale, the subject of which is: the title to a dwelling constituting a separate dwelling, the title to a single-family dwelling or a cooperative title to a dwelling relating to a dwelling or single-family dwellings are exempted from the tax on civil transactions.
The exemption is available if the purchaser is a natural person or persons and none of them is entitled to any of these rights or has shares in these rights on the date of purchase of the right to an apartment or house.
The exception applies to persons who, on the day of the conclusion of the purchase agreement, have or had a share in such rights before that date, but this share does not exceed or does not exceed 50 percent. and was obtained by inheritance. These people can benefit from the exemption, the Ministry of Finance says.
The ministry stressed that the exemption will take effect on August 31, 2023 and will not apply to sales made before that date.
