The European Commission does not intend to officially refer to the question of the referendum proposed by Law and Justice. Commission spokeswoman Anitta Hipper said in an interview with RMF FM journalist Katarzyna Szymańska-Borginon that such decisions are left to the discretion of member states.
However, Anitta Hipper commented on one of the referendum questions, which concerns Poland’s hypothetical reception of illegal immigrants from the Middle East and Africa, in accordance with the “forced relocation mechanism in the EU”. It states that relocation is not mandatory.
An exception for Poland?
Katarzyna Szymańska-Borginon wrote on the rmf24.pl portal that there is a sense of solidarity in the European Union, which, however, leaves the choice between relocating immigrants in one Member State or financing their stay in other countries.
She also added that the EC spokeswoman ruled that Poland qualifies for a complete exclusion from the solidarity obligation, due to the special circumstances Poland is subject to – the war in Ukraine and the pressure of illegal immigrants on the Polish-White -Russian border.
If the assessment were carried out today, given that Poland is home to more than one million Ukrainians, it would be considered a country under migratory pressure and thus itself eligible for solidarity or a full reduction of its solidarity contribution

Kaleta’s response
Sebastiaan Kaleta, Member of Parliament for Sovereign Poland, in response to Szymańska-Borginon’s text, accused the journalist of “spreading manipulation”, which he expressed by publishing his opinion on Twitter.
Once again Mr. @Sz_Borginon is spreading manipulations. Relocation is mandatory because if a country refuses to accept FINANCIAL PENALTIES. In fact, it is stated in the article itself. So we have a mechanism of pure blackmail. In the text, the EC spokeswoman says that Poland theoretically qualifies for an exemption. Only the EC itself decides whether Poland will be released or not. The treaties do not confer such powers on the European Commission, so the whole mechanism is illegal by its very nature. These manipulations prove how important it is for the Poles to say NO to this mechanism in the referendum!
