The Ministry of Justice will have to change its plan to include temporary workers from the Valencia employment service. Consell Jurídic Consultiu objected to the regulatory change that the Gabriela Bravo department plans to implement in order to change the positions of forensic doctors in the Community of Valencia, procedural and administrative management, procedural and administrative proceedings and legal aid of the administration of justice. In case the bags are empty, they are closed with the persons registered in the Labora Office.
Given the lack of staff to cover all these places, the ministry Bravo led has increased the likelihood of applying to people registered with the Valencia employment service and meeting the general requirements for these positions. To implement this route, Justice has prepared a draft decree dated February 2020 to replace the existing one, which sets the conditions for the selection and appointment of temporary staff in the above-mentioned positions.
“If you cannot find applicants according to previous extraordinary procedures, you can go to the Labor Office to request a list of persons who meet the general requirements of this Regulation,” says the text, which started to run in July and July. now stranded at Consell Jurídic Consultiu. When it was understood that the legal body was in conflict with some legal aspects, it expressed its opinion with essential observations, that is, with mandatory amendments.
Sources from the law firm explain that applying for job seekers at Labora to fill these positions, this possibility contradicts the Law on Public Service. Specifically, with clause 18.6 allowing “other means of access for temporary staff” beyond job exchanges “provided they pass a knowledge test”.
This section was amended in the last revision of the law in September and states that “those who passed at least some of the examinations during the last selection process or immediately preceding” may apply for these temporary positions. However, the opinion of Consell Jurídic Consultiu remains unchanged: “Some knowledge tests should be required for staff who choose to start a company through the Lab Office.”
