Zaragoza Court Hears Trial of Benidorm Resident for Alleged Sexual Assault

Yesterday, the First Section of the Zaragoza Provincial Court tried a Benidorm resident identified by the alias Toly as the man accused of sexual assault for allegedly raping the partner of a friend who had moved to La Almunia de Doña Godina in June 2021 to work in the fields. For all this, the public prosecutor is seeking a sentence of eleven years in prison for a continued sexual assault and an additional two years for domestic violence in the family sphere. From the time they arrived in the regional capital of Valdejalón in June 2021 until the complaint was filed on August 8, the plaintiff stated that the accused sexually assaulted her on up to ten occasions. I was dead scared. I only cared about the well-being of those around me, and eventually I yielded because I was very weak, she explained, alluding to threats that Toly made about controlling her daughter and implying that something bad could happen if they stopped having sexual relations.

According to the accused, the two had known each other for thirteen or fourteen years, since he and his wife maintained a friendship tied to drug trafficking. We were partners, he told the provincial court, presiding magistrate Alfonso Ballestín, where he also reaffirmed that it was she who suggested coming to work in Aragón. The victim, in contrast, testified otherwise. She stated that it was he who proposed the arrangement and that she accepted because she did not know what awaited her or what would happen next.

During the plenary session, Toly mistook a trio of journalists seated in the public gallery for one of the Civil Guard officers who had taken his statement after his arrest or for the owner of the home where they lived. They were living in a rented room within a chalet.
